Welcome to the 16p11.2 Genetic Foundation (“Foundation,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Certain programs may be subject to additional terms, consent forms, or privacy notices.

1. About the 16p11.2 Genetic Foundation

The 16p11.2 Genetic Foundation is a nonprofit organization dedicated to education, awareness, advocacy, and research related to 16p11.2 genetic conditions. The Site is intended solely to provide general information and educational resources.

  • The Foundation does not provide medical opinions, diagnoses, or treatment recommendations.

  • Never disregard professional medical advice or delay seeking it because of information from this Site.

Use of this Site does not create a doctor–patient, genetic counselor–patient, or other professional relationship.

For donations accepted through the Site:

Third‑party payment processors are subject to their own terms and policies.

7. California Consumer Privacy Rights

Your privacy rights are important to us. 10. Disclaimer of Warranties

To the fullest extent permitted by California law, the Site is provided on an “AS IS” and “AS AVAILABLE” basis.

The Foundation disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

11. Limitation of Liability

To the maximum extent permitted by California law, the 16p11.2 Genetic Foundation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of

or reliance on the Site or its content, even if advised of the possibility of such damages. This limitation applies to the fullest extent permitted under California law and in light of the disclosures set forth in the Medical Disclaimer.

12. California Civil Code Section 1542 Waiver

If applicable, you waive rights under California Civil Code Section 1542, which states:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor or released party.”

You agree to indemnify and hold harmless the 16p11.2 Genetic Foundation and its officers, directors, employees, volunteers, and affiliates from any claims, damages, or expenses arising from your use of the Site or violation of these Terms.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict‑of‑law principles. Any legal action related to these Terms or the Site shall be brought exclusively in the state or federal courts located in California.
